Privacy Policy

Grouwels Vastgoed B.V. and all its affiliated companies (Grouwels Vastgoed or Grouwels) process personal data on a daily basis. In doing so, Grouwels Vastgoed complies with the General Data Protection Regulation and related legislation and regulations. Grouwels Vastgoed respects the privacy of data subjects and attaches great importance to exercising due care when processing personal data.

Personal data

Personal data is data that provides information about an individual and can be traced back to that individual. This may include data that you have provided to Grouwels yourself, or data that Grouwels Vastgoed has obtained by other means. Grouwels processes various types of personal data for different purposes.

Services

In order to provide you with our services, such as letting your property, we need details such as your name, address, email address and telephone number. In addition, when we first made contact with you, or when you entered into a tenancy agreement, for example, we verified your identity using a valid form of identification. Depending on the nature of your relationship with Grouwels Vastgoed, Grouwels may also process other personal data, such as salary details or your family composition. Where necessary in the context of providing our services or in connection with the agreement entered into, Grouwels Vastgoed will disclose your data to third parties. These third parties include, for example, installation companies, plumbers or contractors, as well as lawyers.

Social Media

Grouwels Vastgoed does not (yet) use various social media platforms, such as LinkedIn, Facebook and/or Twitter. Should Grouwels Vastgoed start using social media in the future and should you use features on our page on these social media platforms, we may process your personal data.

Processors and recipients

In principle, Grouwels Vastgoed does not share your personal data with third parties. However, there are a number of situations in which we do share your personal data with third parties.

Where this is necessary for the performance of the agreement you have entered into with Grouwels, Grouwels Vastgoed will share your personal data with third parties. This applies, for example, when we receive a repair request from you. Where we have obtained your consent to do so, Grouwels Vastgoed will share your personal data with third parties. Your consent is only valid if it clearly states the purpose for which it was given. You may withdraw your consent at any time.

When we ask our external partners to process personal data, Grouwels Vastgoed shares your personal data with third parties. In a number of cases, external processors process personal data on behalf of Grouwels, based on instructions from Grouwels and in accordance with Grouwels Vastgoed’s privacy policy and privacy statement. Appropriate technical and organisational measures are taken to ensure confidentiality and security. This processing will be carried out, amongst others, by our IT supplier, our website administrator, the payroll department, property managers, estate agents and solicitors.

Where a legal provision applies that results in an obligation to disclose personal data, or where the disclosure of personal data is necessary to comply with legislation and regulations, Grouwels Vastgoed will share your personal data with third parties.

Grouwels Vastgoed enters into agreements with its data processors regarding the manner and purpose of the processing.

Employees

Grouwels Vastgoed processes both general and special categories of personal data relating to employees. This is done in the context of the performance of the employment contract, on legal grounds and, where applicable, on the basis of explicit consent given by the employee.

Job applicants

Grouwels Vastgoed processes general personal data of job applicants, such as name, address, email address and telephone number, etc., via email, post or telephone. In addition, Grouwels Vastgoed processes information such as education, educational qualifications and employment history. This relates solely to data that is relevant to the recruitment process. The personal data will be deleted no later than four weeks after the end of the recruitment process. Should Grouwels Vastgoed wish to process the personal data for a longer period, your consent will be sought.

Retention period

Grouwels Vastgoed does not retain your data for longer than is necessary. Where a statutory retention period applies, Grouwels will retain your personal data for at least that period. We retain your personal data for up to 20 years after the end of the (tenancy) agreement.
Transfer of personal data abroad

Grouwels Vastgoed may, where necessary, transfer your data from the Netherlands to another country. If the country to which the data is transferred is located within the European Economic Area, the same level of protection applies there as in the Netherlands. Grouwels will only transfer data abroad if this is necessary for the provision of services. If Grouwels Vastgoed transfers data to a country outside the European Economic Area where the level of protection is not equivalent to that applicable in the Netherlands, Grouwels Vastgoed will comply with the relevant rules set out in the applicable legislation and regulations.
 

Rights of the data subject

As a data subject, you have a number of rights in relation to Grouwels Vastgoed. These rights are set out in the General Data Protection Regulation. You may exercise all these rights in relation to Grouwels by contacting us by telephone or email. We will then arrange an appointment with you. You must bring a valid form of identification with you to this appointment.

Right to transparent information, communication and other rules governing the exercise of your rights.

Right of access. You have the right to enquire whether your personal data is being processed. If your personal data is being processed, you have the right to know which personal data is being processed and how this is done. In addition, you have the right to access your personal data and to receive a copy of it. This right is a kind of auxiliary right, designed to enable the exercise of the rights discussed below.

Right to rectification. This is your right to have your personal data corrected or supplemented. If the personal data being processed is inaccurate or incomplete, you have the right to have it corrected and/or supplemented. If this results in us making corrections or additions, we will pass on these changes to our external partners if this is necessary for the processing.

Right to be forgotten. This is the right to erasure. It gives you the right to have redundant personal data erased. This right also applies to public archives and internet search results. If you exercise this right, the personal data must be erased: it will be completely deleted without undue delay. Grouwels Vastgoed will only proceed with data erasure if
the personal data are no longer necessary for the purposes for which Grouwels Vastgoed processed them;
you withdraw your consent to (further) processing and there is no longer any other legal basis for processing;
you raise a substantiated objection and there are no compelling reasons not to honour your objection;
the personal data has been processed unlawfully by us;
we are required to erase your personal data on the basis of a legal obligation. In certain situations, you cannot exercise your right to erasure. Where this is the case, Grouwels Vastgoed will inform you of this in writing, giving reasons.
Right to restriction of processing. This means that the processing of (certain) personal data is suspended for a specific period, so that an issue can be resolved. For example, if you have discovered that some personal data is incorrect, and you have exercised your right to rectification and Grouwels Vastgoed is still processing your request, you may exercise your right to restriction of processing.

You have the right to require Grouwels, in its capacity as data controller, to inform every recipient of the personal data of any rectification, erasure or restriction of processing. If you request this, Grouwels must provide you with information about the recipients.

Right to data portability. This is the right to data portability. It allows you to request a copy of your personal data in a readable and usable format for yourself or for another service provider.

Right to object. You may object to the processing of your personal data by Grouwels Vastgoed at any time. Whilst we consider your objection, we will restrict the processing (see the right set out under e.), unless Grouwels Vastgoed has compelling legitimate grounds for continuing the processing.

Complaints

If you have a complaint about how your personal data is processed, you may lodge a complaint with the Dutch Data Protection Authority. The Dutch Data Protection Authority will then investigate your complaint.

This privacy statement has been drawn up in accordance with the General Data Protection Regulation and related legislation and regulations. Grouwels Vastgoed reserves the right to update this privacy statement from time to time.
